SLU Shopper Terms and Conditions

Welcome to SLU Shopper.
These Terms and Conditions ("Terms") govern your access to and use of the SLU Shopper website, mobile website, applications, services and related features collectively referred to as the "Platform".
By accessing, browsing, registering with or using SLU Shopper, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Platform.
For purposes of these Terms, "SLU Shopper," "we," "our," or "us" refers to [Legal Company/Owner Name], the operator of the SLU Shopper Platform.
1. About SLU Shopper
SLU Shopper is an online classifieds and marketplace platform primarily designed to connect buyers, sellers, landlords, tenants, employers, job seekers, service providers and other users in Saint Lucia.
Users may use the Platform to advertise, discover and communicate about goods, vehicles, property, services, employment opportunities and other permitted listings.
Unless specifically stated otherwise, SLU Shopper does not own, inspect, manufacture, sell, purchase or take possession of items advertised by users.
SLU Shopper provides the technology that enables users to advertise and communicate with one another. Any agreement to purchase, sell, rent, hire, exchange or otherwise transact is generally made directly between the users involved.
2. Acceptance of These Terms
By creating an account, posting an advertisement, contacting another user or otherwise using SLU Shopper, you confirm that you have read, understood and accepted these Terms.
You also agree to comply with any additional policies published by SLU Shopper, including our Privacy Policy, Listing Policy and any category-specific rules that may apply.
3. Eligibility
You must be at least 18 years of age and legally capable of entering into a binding agreement to create an account or conduct transactions through SLU Shopper.
By using the Platform, you represent that the information you provide about yourself is accurate and that you are legally entitled to use the Platform.
Businesses using SLU Shopper must have the authority to conduct the activities they advertise and must comply with applicable licensing, registration, tax, consumer protection and other legal requirements.
4. User Accounts
Certain features may require you to create an account.
You agree to provide accurate, current and complete information when registering and to keep that information reasonably up to date.
You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.
You must notify SLU Shopper as soon as reasonably possible if you believe that your account has been accessed or used without your permission.
You may not sell, transfer, rent or provide your account to another person without our permission.
SLU Shopper may require users to verify certain information, including an email address, telephone number, business details or identity information.
Verification does not constitute an endorsement or guarantee of a user.
5. Posting Advertisements
Users may post advertisements only for legitimate goods, property, services, employment opportunities or other items permitted by SLU Shopper.
When posting an advertisement, you agree that the information provided will be accurate and not deliberately misleading.
Listings should be placed in the most appropriate category and should accurately describe the item, property, service or opportunity being advertised.
Where appropriate, advertisements should clearly disclose relevant information including condition, price, location, defects, restrictions or other information reasonably necessary for a prospective buyer or interested person to make an informed decision.
You must have the legal right or appropriate authorization to advertise anything you post on SLU Shopper.
6. Listing Images and Content
Images used in advertisements should reasonably represent the actual item, property or service being advertised.
You must not knowingly use photographs, logos, descriptions, trademarks or other material that you do not own or have permission to use.
You remain the owner of content you submit to SLU Shopper.
However, by posting content, you grant SLU Shopper a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce, resize, format and distribute that content as reasonably necessary to operate, advertise and promote the Platform and your listing.
This licence ends within a reasonable period after the content is removed, except where copies must be retained for security, legal, backup or regulatory purposes.
7. Prohibited Listings and Activities
SLU Shopper may prohibit or remove listings involving items, services or activities that are illegal, unsafe, fraudulent, misleading, inappropriate for the Platform or otherwise contrary to our policies.
Unless expressly permitted by SLU Shopper and lawful in Saint Lucia, users must not advertise:
- Illegal drugs, controlled substances or unlawful drug-related products;
- Stolen property or property the seller is not legally authorized to sell;
- Counterfeit or pirated goods;
- Illegal weapons, ammunition, explosives or prohibited weapons;
- Fraudulent documents, identification documents or government credentials;
- Items obtained through fraud or other criminal activity;
- Human trafficking, prostitution or unlawful sexual services;
- Pornographic or unlawful sexually explicit material;
- Illegal gambling services;
- Dangerous or prohibited chemicals;
- Products whose possession, sale or distribution is prohibited by law;
- Endangered or protected wildlife or unlawfully obtained animal products;
- Animals being sold or treated in violation of applicable animal welfare requirements;
- Financial schemes, pyramid schemes or fraudulent investment opportunities;
- Fake jobs or employment opportunities intended to collect money or personal information;
- Property that the advertiser has no authority to rent or sell;
- Items subject to recall where their sale is prohibited;
- Content promoting criminal activity, violence, hatred or unlawful discrimination;
- Malicious software, stolen accounts, compromised credentials or hacking services;
- Personal information belonging to another person without authorization; or
- Any other item, content or service prohibited by SLU Shopper.
SLU Shopper may expand, modify or clarify its prohibited-items rules from time to time.
8. Pricing
Advertisers are responsible for setting the prices displayed in their listings unless otherwise stated.
Prices should be genuine and should not intentionally mislead prospective purchasers.
Where a listing uses "Negotiable," "Contact Seller," "Free," or similar pricing options, the advertiser must use those options honestly.
SLU Shopper may remove advertisements containing deliberately false or misleading pricing.
Unless clearly indicated otherwise, SLU Shopper does not guarantee the price displayed in an advertisement and is not responsible for a user changing or incorrectly entering a price.
9. Transactions Between Users
SLU Shopper is generally not a party to transactions between users.
Buyers and sellers are responsible for agreeing on the terms of any transaction, including price, payment method, delivery, inspection, ownership transfer, warranties and returns.
Users are strongly encouraged to inspect goods before completing a purchase where reasonably possible.
For vehicles, property, expensive equipment and other high-value transactions, users should independently verify ownership and any relevant documentation before making payment.
SLU Shopper does not guarantee that an advertiser owns an item or has authority to sell, rent or otherwise dispose of it.
10. Payments
Unless SLU Shopper specifically provides an integrated payment service for a particular transaction, all payment arrangements are made directly between users.
SLU Shopper is not responsible for cash, bank transfers, deposits, cheques, card payments, cryptocurrency transactions or other payments made directly between users.
Users should exercise particular caution when asked to send advance payments or deposits to persons they have not independently verified.
If SLU Shopper introduces payment-processing services, additional payment terms may apply.
11. Deposits and Advance Payments
SLU Shopper does not guarantee the return of deposits or advance payments made to advertisers.
Users should independently confirm the identity and authority of the person receiving a deposit and obtain appropriate written documentation for significant transactions.
A request for a deposit should not be considered verified merely because the advertiser has an SLU Shopper account.
12. Vehicles
Vehicle advertisements are submitted by users.
SLU Shopper does not independently guarantee a vehicle's ownership, mileage, accident history, mechanical condition, roadworthiness, registration status, financing status or other information contained in a listing.
Prospective purchasers should conduct appropriate inspections and verify relevant registration and ownership information before completing a vehicle purchase.
13. Real Estate
Property listings may be submitted by property owners, landlords, agents or other authorized persons.
SLU Shopper does not guarantee ownership, title, boundaries, planning approvals, availability, property condition or an advertiser's authority to sell or rent a property.
Users should undertake appropriate independent checks before entering into rental agreements, leases, purchases or making deposits.
SLU Shopper is not a real-estate agent merely because a property is advertised on the Platform.
14. Jobs
SLU Shopper provides facilities through which employers and other users may advertise employment opportunities.
SLU Shopper is not the employer unless a particular listing expressly states otherwise.
Employers are responsible for the accuracy and legality of job advertisements.
Job seekers should exercise caution before supplying sensitive personal information.
Advertisements requiring applicants to pay money merely to apply for a job may be removed or investigated.
SLU Shopper does not guarantee employment, wages, working conditions, qualifications or the legitimacy of an employer simply because an advertisement appears on the Platform.
15. Services
Service providers are responsible for ensuring that they possess any licences, qualifications, permits, insurance or other authorization legally required to provide their advertised services.
SLU Shopper does not certify a service provider's competence unless a particular verification programme expressly states otherwise.
Users should independently evaluate service providers before hiring them.
16. Businesses and Dealers
Businesses, professional sellers, dealerships, property agents and other commercial advertisers must accurately identify themselves where required by SLU Shopper.
Commercial users remain responsible for complying with applicable laws relating to consumer protection, warranties, advertising, taxation, licences and business operations.
Nothing in these Terms removes or limits rights that a consumer may have under applicable Saint Lucian law.
Saint Lucia's Consumer Protection Act provides statutory protections relating to the supply of goods and services.
17. Communication Between Users
SLU Shopper may provide messaging, telephone contact, email forwarding or other communication features.
Users must not use these facilities to send spam, threats, abusive messages, scams, malicious links, unsolicited advertising or unlawful content.
We may use automated systems and other reasonable measures to identify fraud, spam or abuse.
Users should not assume that communications from another user have been verified by SLU Shopper.
18. Fraud and Scams
SLU Shopper may use technical, administrative and moderation measures intended to reduce fraudulent activity.
However, no online marketplace can guarantee that every user or advertisement is legitimate.
Users are responsible for exercising reasonable caution when dealing with others.
Suspicious advertisements, messages or users should be reported through the reporting facilities provided on the Platform.
SLU Shopper may suspend accounts or listings that we reasonably believe involve fraud, attempted fraud or other misuse.
19. User Reviews and Ratings
Where ratings, reviews or feedback features are available, submissions must represent a user's genuine experience.
Users may not submit fake reviews, manipulate ratings, threaten another user in exchange for a review, or post knowingly false statements.
SLU Shopper may remove reviews that violate these Terms or our moderation policies.
20. Featured and Paid Listings
SLU Shopper may offer paid services such as featured listings, promoted advertisements, business accounts, subscriptions or advertising packages.
Payment for promotion increases visibility but does not guarantee that an item will sell or that an advertiser will receive enquiries.
Applicable fees will be disclosed before purchase.
Except where required by law or expressly provided by the applicable service, fees paid for services already delivered may be non-refundable.
21. Advertising
SLU Shopper may display advertisements, sponsored listings and promotional content from third parties.
The appearance of an advertisement on the Platform does not necessarily constitute an endorsement by SLU Shopper.
Third-party advertisers are responsible for their claims, products and services.
22. Moderation and Removal of Listings
SLU Shopper reserves the right to review, reject, modify the presentation of, suspend or remove advertisements that we reasonably believe violate these Terms, applicable law or our policies.
We may also remove duplicate, expired, misleading, incorrectly categorized or low-quality advertisements.
We are not obligated to publish every advertisement submitted to the Platform.
23. Account Suspension and Termination
SLU Shopper may temporarily restrict, suspend or terminate an account where we reasonably believe that a user has violated these Terms, engaged in fraud, abused another user, created a risk to the Platform or its users, or used the Platform unlawfully.
Serious violations may result in immediate termination.
Where appropriate and technically feasible, users may be given an opportunity to contact us regarding a suspension or termination.
24. Intellectual Property
The SLU Shopper name, logo, site design, software, databases, graphics and other proprietary materials belonging to SLU Shopper are protected by applicable intellectual-property rights.
Except as expressly permitted, users may not copy, reproduce, distribute, modify, reverse engineer, commercially exploit or create derivative works from SLU Shopper's proprietary content.
25. Privacy and Personal Information
SLU Shopper collects and processes personal information in accordance with its Privacy Policy and applicable law.
Saint Lucia's data protection framework regulates the collection, holding, use, processing, correction and disclosure of personal information.
Users should review the SLU Shopper Privacy Policy to understand the types of information we collect and how that information is used.
26. Electronic Communications
By using SLU Shopper, you agree that certain communications between you and SLU Shopper may occur electronically, including through email, website notifications, SMS or other electronic methods where permitted.
Saint Lucia has legislation recognizing and regulating electronic communications and transactions.
You are responsible for maintaining accurate contact information associated with your account.
27. Platform Availability
We aim to make SLU Shopper reliably available but do not guarantee uninterrupted or error-free access.
The Platform may occasionally be unavailable because of maintenance, upgrades, security incidents, telecommunications failures, hosting problems or circumstances outside our reasonable control.
Features may be introduced, modified or discontinued from time to time.
28. No Guarantee of Transactions
SLU Shopper does not guarantee that:
an advertisement will receive responses;
an item will sell;
a buyer will complete a purchase;
a seller will complete a transaction;
a property will be rented or sold;
a job applicant will receive employment;
a service provider will receive work; or
information supplied by another user is accurate.
Users make their own decisions concerning whether to transact with another person.
29. Disclaimer of Warranties
To the fullest extent permitted by applicable law, SLU Shopper is provided on an "as available" basis.
We do not warrant that every advertisement, user, product, service or communication appearing on the Platform is accurate, legitimate, safe, suitable or available.
Nothing in these Terms excludes warranties, guarantees or rights that cannot legally be excluded under applicable law.
30. Limitation of Liability
To the fullest extent permitted by law, SLU Shopper and its owners, employees, officers, contractors and affiliates will not be responsible for losses arising solely from transactions or disputes between users, including loss resulting from fraudulent listings, non-payment, defective goods, failed deliveries, misrepresentations or disagreements between buyers and sellers.
SLU Shopper will not be liable for indirect, incidental, special or consequential loss to the extent such liability may lawfully be excluded.
Nothing in these Terms is intended to exclude or restrict liability where doing so would be prohibited by law.
31. Indemnification
To the extent permitted by law, you agree to be responsible for claims, losses or reasonable costs arising from your unlawful use of SLU Shopper, your violation of these Terms, your infringement of another person's rights, or content or advertisements that you submit to the Platform.
32. Reporting Illegal or Inappropriate Content
Users may report advertisements, messages or accounts that they believe violate these Terms or applicable law.
SLU Shopper may investigate reported content and take appropriate action.
Where reasonably necessary or legally required, SLU Shopper may preserve information and cooperate with lawful requests from competent authorities.
33. Safety
Users are responsible for taking reasonable safety precautions when meeting another person or completing an offline transaction.
For significant transactions, users should consider meeting in an appropriate public or secure location and independently checking goods and documentation before payment.
Users should never provide passwords, verification codes, online banking credentials or other account-security information to another SLU Shopper user.
34. External Links
Listings or advertisements may contain links to websites or services operated by third parties.
SLU Shopper does not control those external services and is not responsible for their content, security or privacy practices.
Users access third-party websites at their own discretion.
35. Changes to These Terms
SLU Shopper may update these Terms when necessary because of changes to the Platform, our business practices, legal requirements or security considerations.
The current version will be made available on the Platform and will identify the date on which it was last updated.
Material changes may also be communicated through the Platform or by other reasonable means.
Continued use of SLU Shopper after updated Terms take effect constitutes acceptance of those Terms where permitted by law.
36. Severability
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
37. No Waiver
A failure by SLU Shopper to enforce a provision of these Terms does not mean that we waive our right to enforce that provision in the future.
38. Governing Law
These Terms and your use of SLU Shopper are governed by the laws of Saint Lucia, without prejudice to any mandatory rights or protections available under applicable law.
Any dispute that cannot be resolved informally will be subject to the jurisdiction of the courts of Saint Lucia, unless applicable law requires otherwise.
